"If you're asked to sign an #NDA (non-disclosure agreement) / confidentiality agreement, take the time to read it thoroughly, and understand exactly what its impact is on you.
There are myriad ways that an NDA can trip you up so, while they definitely have justified uses, treat them with appropriate care and caution.
Something I've noticed about many (perhaps even most) of the #lawyers here on #Mastodon is that there seems to be less of a tendency to correct every inaccuracy, however minor, that might arise in a comment or reply, or demonstrate their superior knowledge or experience by inserting themselves into a thread started by another lawyer in an effort to play the one-upsmanship game...
That was a huge irritation on the social media site formerly known as birdchan...
Any #trademark#lawyers out there? Say a parent company shutters a subsidiary and pulls product from market, does the subsidiary’s mark ever become available to others? Example: Coca Cola closes Sprite and Sprite is no longer made, marketed, sold. I feel the answer is the parent can keep the mark in perpetuity, but I want that to be wrong. #law#lawfedi#lawyer#IntellectualProperty@law
What is even more infuriating about Justice Alito's complaints about criticism of the Court is that he and other conservative Justices questioned whether our society had become "too sensitive" when considering whether the First Amendment is a defense to cyber-stalking.
The #Mississippi Supreme Court Moved to Ensure Poor Criminal Defendants Would Always Have a Lawyer. It’s Not Working.
Months after the state’s highest court directed judges to ensure that all criminal defendants have legal representation while awaiting indictment, one justice has acknowledged that the rule isn’t being widely followed.
After brashly declaring he wanted to #testify in his #criminal trial, it appears increasingly unlikely that #Trump will do so, as the #jury seems poised to hear #ClosingArguments next week.
Defendants rarely testify, because their #lawyers advise them that the risks of doing so, particularly when it comes to being questioned by prosecutors #UnderOath, are simply too great.
The Federal Court’s ruling against Peninsula Health could set a precedent for junior doctors from hospitals across the country being awarded hundreds of millions of dollars in compensation.
I have been struggling with retaining information, particularly related to my work. Anything detailed, like specific processes/procedures, case names & details, etc, I just can't recall and have to look up. It hasn't always been this bad, but I don't know if this is a #parenting brain thing, a #LongCovid thing, an #anxiety thing, or just "I'm not 30 anymore". Anyone else dealing with this (esp #lawyers#LawFedi) have any advice?
The legal profession is due for a reckoning. Lawyers are guardians of the rule of law. We need to reassert that role--in law schools and within the bar.
“This is arguably one of the most important bar disciplinary cases in history — full stop. A lawyer sworn to uphold the rule of law is charged with attacking the rule of law. … If the bar doesn’t hold him to account for that, it’s hard to understand how the system can function, going forward.”
Fellow #LawProfs & other #lawyers I'm tagging things I think might make a potentially interesting #LawStudentNote topic when I see/think of them. Feel free to join me. All ideas free to a good home. #LawFedi
Mississippi Says Poor Defendants Must Always Have a Lawyer.
Few Courts Are Ready to Deliver.
A rule requiring poor criminal defendants to have a #lawyer throughout the #criminal process took effect Saturday. Few #courts in the state have plans in place.
Trump's team is more focused so far on building a sprawling network of "#ElectionIntegrity" #lawyers & #PollWatchers than on rounding up organizers & door knockers to reach voters.
It's a sign that 5 months before Election Day, the legal battle is underway —& that Trump PLANS to cry "rigged" if he loses, as it did after the #2020election & his #felony#convictions.
excellent, concise piece that not only explains the seriousness of the #election interference case (aka the hush money case, which is more salacious-sounding and therefore used more often) but the incorrect arguments, offered by some #lawyers and #media (this coverage contributed to my dropping the #WashingtonPost, I believe it was a #RuthMarcus piece poo-pooing the case) about the seriousness of the case (buttressed of course by calling it the hush money case).
Solicitor General Elizabeth Prelogar is simply one of the best #lawyers in the United States of America. Brilliant, eidetic memory, persuasive, and just all-around incredible.
