The #SupremeCourt on Tues cleared the way for Texas to immediately begin enforcing one of the nation’s harshest immigration laws, which opponents say would disrupt more than a century of #federal control over #international borders.
The divided decision was preliminary & urged a lower court to quickly decide whether to allow the #law to remain in effect while appeals continue. That approach drew dissent from the 3 liberal justices, 2 of whom said the majority was inviting “further #chaos & #crisis in #immigration enforcement.”
“The Court gives a green light to a #law that will upend the longstanding #federal - #state balance of #power & sow #chaos,” wrote Justice SoniaSotomayor, joined by Justice ##KetanjiBrownJackson. They noted that a lower court judge had concluded “that it is likely #unconstitutional.”

E.G., it could say its holding does not extend to conduct related to (a) foreign affairs, or (b) powers textually assigned to #POTUS, like the pardon power or the power to recognize ambassadors....
Now even that isn't clear—is the president immune from a bribery prosecution for sale of pardons?
The point is that a ruling that addresses #SeparationOfPowers questions, like the ones Jack Goldsmith has raised, doesn't necessarily require remand & fact-finding.

While also in his case no one has ever personally seen the commandment thrown down on earth by God himself, designating him & the Pope that one clerical guy, who'll never err.
