@taylorlorenz I do feel somewhat lucky as an elder millennial (1981) that I've managed through a couple coincidences and dumb luck to get those things. The house was admittedly courtesy of getting shot at in Iraq twice (but yay tax free money) and the job has been first line retail management for 18 years so neither is the most open to others but still doable I guess.

Remember:

There were possible crimes, but tax and reporting crimes are not election interference.

There is also a circular thing with Cohen and Pecker telling the court that they expected Trump to pay back the hush money payments.

If they expected to get paid back, it was a loan to Trump and not a contribution. Right?

@Teri_Kanefield It may be missing something but I suspect there's a pretty cut and dry case for the misdemeanor on records falsification but they couldn't toll the clock if that was all they had.

So I guess my question is if the jury can even weigh in on the misdemeanor as a lesser included crime OR do they have to find it rising to the felony level or acquit?

If you have friends who are unglued about the Supreme Court decision and are simplifying the conclusions, you can send them to the piece I just posted.

In addition to being done well, it was done quickly. SCOTUS gave them a week. They filed it in 2 days.

Notice that they argue in the alternative: If Trump gets a stay, please expedite the proceedings as with the Colorado ballot case.

@Teri_Kanefield one thing that has seemed fairly consistent with the DC trial is that Smith's team never seems surprised and never scrambling to respond. They have been sloppy at times (thinking back to the points you raised during the gag order saga) but they never seem to be playing catch up with any maneuver Trump's team pulls.

The one thing that I'm always most inclined to say to the kind of person that posts this is to ask "Who". Like, I have plenty of beef with Biden but if you think somebody different is called for then you damn well better have an actual name. Like the votes have already started for the primary it ain't time for "somebody" it's either pick an actual live and viable physical person or start working to shift the policy debate because the candidate debate is over.

I would change "likely" to "possibly."

I am not persuaded that the Supreme Court will take the immunity issue. I would give it less than a 50% chance instead of more.

@Teri_Kanefield @seanbala I do wonder if there might also have been a sense of requiring Trump to fight on even more fronts. I mean I know there are billionaires backing the legal defense but even if the gag order was not the best put together item it also sucks time and energy from the defense and I think Smith has more of that available to him.

@GottaLaff @Teop_Versant The Volt PHEV was first sold in 2010 with the Prius PHEV in 2012. Between those teams, the BMW electrics, Ford's push into the field...this is a decade plus old market for the rest of the field. What I can't find is any major recalls or lawsuits associated with any of the major hybrid/PE vehicles in this period. I'm sure there are some but the issues have been with non-EV components like the big airbag recall a few years back or the Toyota window switch.

In the J6 DOJ trial (the big one) yesterday was Trump's deadline for filing pretrial motions.

(See attached minute order)

No surprise, his lawyers filed a bunch of motions just before the deadline.

Here's the thing about defense motions in criminal proceedings: Defendants are given lots of leeway to file motions that don't have a chance. The lawyers run into trouble only if they lie or misrepresent facts.

This is because of how much is at stake in criminal cases.

@Teri_Kanefield I'm also curious if the court or the SC will ever get exasperated enough to find the filings deficient since they refer to "President" Trump...who doesn't exist and isn't on trial. I know it would be fairly petty but I'm almost surprised it hasn't come up yet.

@Jerry @GottaLaff Each court has it's own bar so DC District court has a separate bar from the DC Court of Appeals. Since you have to pay for each bar you register lawyers tend to only register where they usually do business. Lauro is admitted to the bar of the DC District court but needs to join the Appeals bar. Since he is in good standing he just has to fill out a form and then pay a filing fee, it's a logistical road bump not anything serious.

    @Teri_Kanefield Minor thing with the filing USCA-DC apparently notified Lauro that he isn't admitted to the bar for the Appeals court. Is that a common thing for lawyers to be in the bar for the district court but not the attached appeals court?

    @Teri_Kanefield Im inclined toward the idea that Meadows could sustain "acting under color" but the open point might be on the "colorable federal defense." Reading Willingham it does seem like there is a need for Meadows to show that removal is needed in order to raise a defense under Federal law and its gonna turn on Meadows' Supremacy Clause defense....I guess my question is do you think that's a fair read on what the key point will be?

    My dream of setting up a Mac Mini as a combo torrent seedbox / Plex server seems to be dying. To do so I need a VPN with both 1) port forwarding, 2) split tunneling on Macs, so I can exclude the Plex app from the VPN. No VPN appears to offer both, and the number of VPN services that offer port forwarding at all is dropping as we speak - two major VPNs just announced they were ending port forwarding in the last month!

    @adamconover it would be a different network topography but you could maybe get a router-hosted VPN client and then have the router itself handle the split tunneling. I started working on this for my home network to get around some geo blocks but it would require an enterprise grade router that I couldn't justify.

    Firstly, I cannot believe the video did that well. Hour-long videos definitely aren't gonna be the new norm for me, but let that be a lesson to those afraid of making long videos.

    On this trip we've rented a Toyota Highlander, and my mom and dad have the closely-related Toyota Sienna.

    I gotta say, if you're not looking at the minivan for whatever silly reason you think you might have, you're making a mistake. It is astonishing how much tighter and confined it feels in the Highlander when it's nearly the same size.

    Minivans are simply packaging heroes and y'all need to get over it.

    @TechConnectify When the wife and I decided we needed a big hauler for all the kiddos stuff we looked at a bunch of SUVs before just going with the Pacifica and I've never regretted it since. Just easier to get in and out of, easier to load and unload, easier to drive and easier to deal with bad weather.

    @Teri_Kanefield the one thing, and obviously this is coming at it from a lay perspective, that gets me is the NARA IG referral. Now I don't know how often referrals from agency IGs get turned into investigations but the fact that the reporting has the issue being shunted to the side is concerning to me. Having the kind of predicate that the referral offered and not at least exploring that avenue seems like, at the very least, a failure of imagination and urgency at DOJ leadership.
