NL childcare benefits scandal.

In a hardened political and social climate, the three state powers have been blind to people and law. Basic human rights have been violated and the rule of law has been cast aside. This, in summary, is the main conclusion of the official Commission of Inquiry in its report ‘Blind to People and Law’, which it presented today.

‘The AI Act's debiasing exception to the GDPR’

A new blog post by Marvin van Bekkum & me.

The AI Act includes a debiasing exception to the General Data Protection Regulation's ban on using sensitive data (special categories of data). The EU considerably improved the text of the exception, compared to the first draft by the European Commission, adding several safeguards for processing sensitive data.

Dutch website @Tweakers tried a model without tracking-based ads, but stops again. 2 main problems apparently: lack of measurement capabilities & a way of working that is completely different from how online advertising usually works. Advertisers are used to being able to measure how their banners are performing themselves, but with Tweakers, this is not possible.
So: less income. https://tweakers.net/plan/4126/tweakers-stopt-met-trackingvrije-advertenties.html

The European Court of Human Rights (ECtHR) emphases that encryption contribute to ensuring the enjoyment of privacy and other fundamental rights, such as freedom of expression. Case of Podchasov v. Russia (no. 33696/19).

https://hudoc.echr.coe.int/eng/?i=001-230854

Frederik_Borgesius,

'In the digital age, technical solutions for securing and protecting the privacy of electronic communications, including measures for encryption, contribute to ensuring the enjoyment of other fundamental rights, such as freedom of expression (…). Encryption, moreover, appears to help citizens and businesses to defend themselves against abuses of information technologies, such as hacking, identity and personal data theft, fraud and the improper disclosure of confidential information.' (par 76)

Frederik_Borgesius,

'Weakening encryption by creating backdoors would apparently make it technically possible to perform routine, general and indiscriminate surveillance of personal electronic communications. Backdoors may also be exploited by criminal networks and would seriously compromise the security of all users’ electronic communications. The Court takes note of the dangers of restricting encryption described by many experts in the field' (par 77)
