UK trade union law breaches workers' human rights as it does not protect them from sanctions short of dismissal for taking part in industrial action, the Supreme Court ruled today.

"The right of an employer to impose any sanction at all short of dismissal for participation in lawful industrial action nullifies the right to take lawful strike action," Judge Ingrid Simler said in the court's written ruling.

Talk among Tories of leaving the ECHR is reaching fever pitch (again), so its as well to be reminded about what the consequences of leaving the European Convention on Human Rights would & wouldn't be.

Whatever the practical issues, as Joelle Grogan (King's College) concludes, not only would it encourage further withdrawals, leaving the ECHR would be one more element in the destruction of the UK's (already floundering) global reputation, with further consequences.

A caller to on the subject of James Cleverly depicting the regular peace protests in London as "Mob Rule" starts with "I believe in the right to peaceful protest..."

There is of course a But: "But if the demonstrators are breaking the law..."

Nick Ferrari interrupts: "But they're not [breaking the law] are they - THAT'S THE PROBLEM..."

Anyone else get the feeling Nick's support for the right to protest is conditional on who you are?

They don't even need to be autocrats - any democratic constitution that grants majoritarian power to a minority (like Boris Johnson's 80 seat majority on 44% of the vote) has the right to pass Bad Law that is perfectly legal except...

Except when an overarching law like the or allows the courts to judge Bad Law as unlawful.

The Nastiz get this - this is why they wanted to leave the EU (to nullify the ECFR) and why they want to abrogate the ECHR and HRA.

In a case involving Telegram vs Russia, European Court of Human Rights decides that the right to (messaging) privacy is inviolable, thus also siding with the EU Parliament who opposed the Commission's plan to ban unbreakable end to end encryption. This should end that particular proposion for good.
