@design_law@mastodon.social

Art major turned law professor. Teaching #Patents, #DesignLaw & #CivPro at #SuffolkLaw.

Researching & writing about #DesignPatents. Currently thinking a lot about the #ScheduleA phenomenon.

Trying to make #PatentFedi happen.

Coauthor of Patent Law: An Open-Access Casebook https://patentlawcasebook.com/

When I'm not thinking about law, I'm usually studying languages (#español, #français & #svenska), reading novels, or watching Netflix.

Don't listen to anyone who says "likes don't matter" on here.

Yes, it's true that there's no algorithm for them to feed.

But letting people you know that you like what they're sharing, that you agree with them, that they're not just shouting into an empty abyss? That matters.

"Mastodon is far from perfect. But I only have so many hours in the day, and only so many days left in my life. I would much rather spend those precious hours making a open service better than using a temporarily superior closed one. I have seen that movie. I know how it ends."

One suggestion: If you want the fedi to be a welcoming place, don't jump in to someone's mentions to explain the fedi UNLESS explicitly asked to do so.

"But...."

But nothing. This place will survive a little technical misunderstanding or misstatement.

It will not survive newcomers being bombarded with endless fedisplaining.

PSA: If you see a woman respond to a troll, it is never--ever--helpful to respond to her with something along the lines of "just ignore them."

She's probably ignoring 100 (or more) for every 1 she chooses to respond to. She knows that the path of least resistance is to ignore the troll & move on. She doesn't need you to inform her of that option.

A response is a conscious decision. You are not helping when you criticize (because that's what this is) that decision.

So, RSS Parrot is my new favorite fedi thing. You can use it to follow blogs, websites, podcasts, even Bluesky users: https://rss-parrot.net/

"For me, Mastodon and the so-called 'Fediverse' are rewinding the clock on social media in the best way possible. Its usage is more intuitive on both the publishing and subscription side without a big-A Algorithm deciding what your see. If you found utility using early Twitter and early Facebook, then you’ll instantly find Mastodon a more pleasant and intuitive experience."

Periodic reminder that "introvert" is not a synonym for "shy" or "bad at public speaking." We can talk to random strangers, we can speak to large audiences. It just exhausts us.

This. This is why I stopped posting over there:

"People don’t come to Twitter for its far-right hate content. Nor do the advertisers come to market to them....The fact of the matter is, people come to Twitter for news, culture, discussions. By staying, you don’t hold any ground, you maintain the viability of a platform hell-bent on promoting far-right ideology. So long as there’s content other than hate, people will have a reason to stay."

So, it's officially been (a bit over) a year since I came to the fedi. I don't miss Twitter at all. I miss some people there, of course. But I don't miss the "gotcha" culture, the near-constant mansplaining, all the tiny bits of nastiness that just wear on you, day by day. And of course, that was before it became all of what it is today. Thank you, friends for a great year. Looking forward to many more.

"In a statement posted online Friday evening, Scholastic said it was necessary to segregate these titles because 'there is now enacted or pending legislation in more than 30 U.S. states prohibiting certain kinds of books from being in schools....'"

"What laws Scholastic believes would expose schools to liability for offering these books? Scholastic declined to answer the question."

Are you new here? Giving this place another try? Welcome!

I've been here for a few months and the best advice I've gotten so far is: Follow a lot of people. Like a lot. Like way more than you would have on the other site.

If you're worried about losing track of certain people/issues in the flood of your Home feed, use lists (and the advanced view on the web interface): https://mastodon.social/@design_law/109358875682926700

OMG, people. If someone posts about their OWN LIVED EXPERIENCE, don't try to "correct" them.

Court orders Trader Joe's to pay workers' union $112,622.12 in attorneys' fees for defending against the "exceptionally weak" trademark lawsuit:

"Employers should be discouraged from bringing meritless claims against unions they are challenging at the ballot box."

It's syllabus time! Did you know that my coauthors and I have put out a (free) supplement for anyone who wants to add one day on design patents to their IP class:

We also have a full (also free) Patents book, available at: https://patentlawcasebook.com

No, Google Translate, I absolutely did not.

(By the way, this is a super troubling sign of degradation in this otherwise valuable tool.)

I think something that a lot of event planners are missing in the current still-in-a-pandemic stage is that, for a lot of people, the choice isn't: Attend onsite or attend online? It's attend online or don't attend.

The accuracy:

"If you’re a man and that O.P. is a woman, her facts are feelings and your feelings are facts, and those forty-seven increasingly lengthy responses you fired off were clearly a rational reaction. If she reacted negatively to them, do not forget to rebuke her for being emotional."
