@Nonilex Besides, striking comments like that is 100% futile. Actually it's worse than futile; it just draws attention to them. The old saying is "if you throw a skunk into the jury box, you can't instruct the jury not to smell it," but if you TRY to instruct the jury not to smell it, you'll just get them thinking really hard about how bad it is.

Via Andrew Weissmann said this last night. These are creative, and hopefully potentially effective, options:

options in addition to fine/jail:

  • put a monitor over his use of social media posts
  • hold sentence on a contempt finding until after trial over
  • advise Trump that his contempt of gag order can be considered at sentencing upon conviction.

All can be used by Judge Merchan.

@MarkRDavid @GottaLaff I came here to say that. His social media posts are quite closely monitored already. It's not like he can post stuff on Truth without anyone noticing. If there were a court-appointed monitor, then one more person would notice, but that doesn't address the question "so, then what?"

@Nonilex Of course, the MAGA responses to that would be (a) everybody knows the National Bureau of Whatever is a front for the Biden crime family, so of course they're lying, (b) that's because law enforcement ignores crime by immigrants and goes after white US-born men because they're all run by woke politicians, and (c) that's because immigrant criminals are sneaky and devious and learned how to not get caught from criminal masterminds back in their home countries. There's no point trying to persuade these people with facts (not, I realize, that that's what you were trying to do).

@BohemianPeasant @Nonilex The concern is that if Trump is actually elected <delicate shudder> and there hasn't been a verdict yet, he's likely to immediately appoint an Attorney General who will fire the Special Counsel and dismiss the entire case. Whether an AG can do that or not is unclear to me; the point of special counsels is that they're supposed to be independent from the rest of the Justice Department. But the general idea is that if Trump is President, he's the head of the branch of government that's responsible for prosecuting people in federal courts, and that's a Bad Thing when he himself is being prosecuted in a federal court.

On the other hand, even if he wins the election, he won't be President until January 20, 2025, so they'd still have a shot at convicting him,

My clever Henry did a really nice thing for me today. The track wheel on my fancy Logitech Lightspeed gaming mouse had quit working, and I had resigned myself to having to buy a new one. Right about when I was discovering that this model has become kind of rare and they're painfully pricey to replace, Henry jumped up onto my desk and kicked the mouse to the floor. The battery cover came off and the battery came out. When I reassembled it, the scroll wheel was working. Good boy Henry!

@Nonilex I have to wonder: so, ok, in Alabama, if you destroy a frozen embryo, you can be sued for wrongful death. I have to wonder how far this principle extends. The obvious next step is prosecution for homicide by the government, and that's very likely coming soon. But isn't the very act of freezing it in the first place egregious child abuse? Shouldn't people who do that be punished exactly the same way as a parent who puts what I guess I now have to call a "post-birth baby" in the freezer?

@jotokla @amyfou @qurlyjoe According to etymonline.com, it's probably derived from "yoicks," a fox-hunting call that was supposed to get the hounds moving. Which doesn't help, because that just raises the question of why it takes more than one yoick to accomplish that.

@Minimus Ok, interesting. I don't recall deponent verbs. Maybe they hadn't been invented yet; I took Latin a really long time ago.

Does that explain "res ipsa loquitur"? We translate that as "the thing speaks for itself," but I always assumed, because of the passive ending, that it literally means "the thing is spoken by itself." But maybe that's another one of those deponent verbs?
