Just read the DC Circuit’s opinion upholding lower court determination that X, formerly known as you-know-who, was in contempt of a search warrant when X delayed turning over materials related to Trump’s account. The opinion is technical in places. The main substantive issue is whether X had a #FirstAmendment right to communicate with #Trump about the warrant. 1/ (thread) Opinion at https://storage.courtlistener.com/recap/gov.uscourts.cadc.39513/gov.uscourts.cadc.39513.1208541751.0.pdf #LawFedi

Pay attention to what's happening in this case: the Fifth Circuit Court of Appeals just essentially ruled that it's fully legal to jail journalists for reporting leaked information, or any information they obtain from government officials without going through "proper channels."

This is a serious issue for #journalism in #Texas, #Louisiana and #Mississppi and we should hope the Supreme Court sets things right quickly. https://www.texasobserver.org/priscilla-villarreal-journalist-la-gordiloca-fifth-circuit/ via @TexasObserver

Is free speech in trouble on college campuses?

The controversy over university presidents who gave lawyerly answers in Congress about punishing students who call for genocide reflects the reality of college free speech codes that try to both encourage debate and stop hatred.

A expert provides some needed context:

Judge is holding a hearing on several pending pretrial motions in the case, including a -related motion from Team

This is the 1st hearing since McAfee ruled on the disqualification motion, which defendants have until Mon to appeal.

It's also the 1st hearing w/o special prosecutor as lead for the DA's office.

Supreme Court will decide on First Amendment protections for social media.

The court has the opportunity to reexamine the nature of content moderation and the constitutional limitations of the government regarding speech on platforms such as Facebook, X, TikTok, and Instagram.

Quotes from #DeSantis' book "support the company’s central allegation: that the #Republican governor improperly wielded state power to punish Disney’s speech criticizing his policies, violating the #FirstAmendment.

Memoirs by presidential aspirants often lay out a blueprint for their coming candidacies. DeSantis’s does, too. It boasts extensively about his war on #Disney to advertise how he would marshal the powers of the presidency against so-called woke elites."
